These Terms of Service ("Terms") form an agreement between you and BuilderBuzz ("we", "us") and govern your use of builderbuzz.ca, our client dashboard at app.builderbuzz.ca, and the SEO, AEO and related services we provide (together, the "Services"). By using the Services, creating an account or subscribing to a plan, you agree to these Terms. If you are accepting on behalf of a business, you confirm you are authorized to bind it.
If you have a separate signed agreement or proposal with us, that agreement takes priority where it conflicts with these Terms.
1. Our services
We provide search engine optimization, local search, Answer Engine Optimization (AEO), content, reporting and related services for construction businesses. The specific scope of your plan, including the number of target keywords and the deliverables, is described in the plan you choose or the proposal we agree with you.
2. No guaranteed results
Search engines and AI assistants decide rankings and recommendations using their own systems, which we do not control and which change often. We use professional, ethical best practices, but we do not guarantee any specific ranking, position, traffic level, number of leads, revenue or timeline. Results described on our website are examples and are not a promise of what you will achieve.
3. Your responsibilities
- Give us accurate information and the access we reasonably need, such as to your website, Google Business Profile, Search Console or Analytics.
- Confirm you own or are allowed to use any content, logos, photos and trademarks you give us, and that our use of them as directed will not infringe anyone's rights.
- Review and approve content we prepare for you where we ask you to. You are responsible for the accuracy of claims about your business, such as licences, warranties and pricing.
- Keep your dashboard login details secure and tell us promptly about any unauthorized access.
4. Plans, billing and payment
- Plans are billed monthly in advance, in the currency shown on your invoice, through our payment processor, Stripe. Applicable taxes are extra.
- Your subscription renews automatically each month until you cancel.
- By subscribing, you authorize us to charge your payment method each billing period. If a payment fails, we may pause work and dashboard features until the account is brought up to date.
- We may change plan prices with at least 30 days' notice. Changes apply from your next billing period after the notice, and you may cancel before they take effect.
5. Cancellation and refunds
- Cancel any time. There are no long-term contracts. You can cancel from your dashboard billing portal or by emailing contactjosh@builderbuzz.ca.
- Cancellation takes effect at the end of your current paid billing period. You keep access to your plan and dashboard until then, and you will not be charged again.
- No refunds. Payments are non-refundable, including for partial months, unused keywords or unused services, except where a refund is required by law.
- Upgrades take effect when we confirm them. Downgrades take effect from your next billing period.
6. Using the dashboard and website
You may use the Services only for lawful purposes and only for your own business. You must not:
- copy, resell, scrape or reverse-engineer the Services or the data in them;
- try to access accounts or data that are not yours, or interfere with the security or operation of the Services;
- use the free website check or other tools in an automated way or to overload them;
- upload anything unlawful, harmful, infringing or containing malware.
We may suspend or close accounts that break these rules.
7. Third-party services
The Services rely on third parties such as Google, Stripe, Supabase and data providers. Your use of connected Google accounts is also subject to Google's terms. We are not responsible for third-party services, their availability, or changes they make that affect search results or data.
8. Intellectual property
We own the Services, our software, dashboard, methods, templates and branding. Once you have paid for them, you own the content we create specifically for your website, such as page copy, and may keep using it after you cancel. Reports and data in your dashboard are provided for your own business use. You give us permission to use your business name and logo to provide the Services and, with your approval, to mention you as a client.
9. Confidentiality and privacy
Each of us will keep the other's non-public business information confidential and use it only to perform under these Terms. Our handling of personal information is described in our Privacy Policy.
10. Disclaimers
Except as expressly stated in these Terms, the Services are provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, uninterrupted availability or that data from third-party sources is error-free.
11. Limitation of liability
To the maximum extent permitted by law, BuilderBuzz will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue, leads, data or goodwill. Our total liability for any claim relating to the Services is limited to the fees you paid us in the three months before the event giving rise to the claim.
12. Indemnity
You agree to indemnify BuilderBuzz against claims arising from content or materials you provide, your business's products and services, or your breach of these Terms.
13. Ending the agreement
You may stop using the Services and cancel as described in section 5. We may end or suspend the Services with notice if you breach these Terms or do not pay, or with 30 days' notice for any other reason. Sections that by their nature should continue (such as payment, intellectual property, liability and governing law) survive termination.
14. Changes to these Terms
We may update these Terms from time to time. We will post the new version here with a new "last updated" date and notify clients of material changes by email or in the dashboard. Continuing to use the Services after changes take effect means you accept them.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You and we agree to the exclusive jurisdiction of the courts of Ontario.
